Nursery worker jailed over ‘shocking’ death of toddler while he slept

  • Nursery worker Kimberley Cookson has been jailed for three years and four months for the gross negligence manslaughter of 14-month-old Noah Sibanda at Fairytales Day Nursery in Dudley.
  • CCTV footage revealed Cookson tightly wrapped Noah in a sleeping bag, placed a blanket over his head, laid him face down in an indoor tepee, and restrained him with her leg before leaving him unchecked for two hours on 9 December 2022.
  • Noah was found unresponsive and later died, with the judge describing the nursery's practices as "shocking" and highlighting "established" dangerous sleeping routines for infants.
  • Nursery owner Deborah Latewood received a six-month suspended jail sentence for a Health and Safety at Work Act offence, while the firm operating the nursery was fined £240,000 for corporate manslaughter.
  • Ofsted, which ordered the nursery's closure, expressed sorrow for Noah's family and mentioned new government funding to allow for more frequent nursery inspections.
